
Michael A. Scott has been termed a ‘vexatious litigant’ by the court for his persistence in bringing court cases one after another trying to expose what he feels to be injustices.
A man of modest size with polite manners and a scholarly appearance he handles his own cases. He pens the plaint and the writing seems the handiwork of a man of knowledge with an organized mind. He often cites precedents and statues in pages and pages of arguments to substantiate his claims.
The fact that innumerable of his claims have been dismissed has not deterred him from proceeding along the same tracks. Even when nearly all the rulings were poised to go against him, he persisted doggedly.
He gained victory in 1997 when the jury gifted him nearly $10,000 from Norfolk Southern regarding an injury he had sustained in his working place. The court ordered that he should be given slightly less than half of that amount because the jury had also found that he too was responsible for the injury.
But after many years of hearings swinging to and fro the federal judges have finally noted that he is making use of the judicial system to harass his opponents. Hence the judges have ordered that he has to get permission prior to filing any complaint. Many of these who had been sued by Scott wanted sanctions to be imposed upon along with contempt rulings. Stanley Barr, an attorney place an affidavit with the court saying his clients have incurred more than $124,000 expenses towards legal costs thanks to the activities of Scott.
Scott had brought cases against people considered to be immune from legal suits. One such person was Judge Poston. He sued the lawyers who defended those against whom he had brought charges. He tried to declare some statues of the state unconstitutional. He tried to realize damages of over $100 million.
Scott spread a wide legal net invoking Declaration of Right, the Antitrust Act, Consumer Protection Act etc. He sent copies of his actions taken to the media, politicians and the FBI. It caused all round vexation.
At a time when foreclosure cases are being quickly disposed off or allowed to languish in favour of the lenders a person like Scott is required to focus on the injustice done to borrowers.
